Spencer Elden has claimed that he was unable to give his consent for appearing on the 1991 album with him naming Nirvana’s surviving members, the estate of Kurt Cobain, photographer Kirk Weddle and the labels behind the album’s release in the lawsuit. He's gone onto claim that the image amounts to child pornography and sexual abuse owing to the fact that Spencer's genitals were shown on the cover without being cencosered.

Elden claims he has suffered damages across the course of his life along with adding that his legal guardians never signed a release “authorizing the use of any images of Spencer or of his likeness, and certainly not of commercial child pornography depicting him.” He’s also filed a case suing the relevant parties for distribution of private sexual materials, negligence, and what he says was a “sex trafficking venture” where he was “was forced to engage in commercial sexual acts while under the age of 18 years old.”
For a person who has been extremely willing to come out in public as the Nevermind baby, its beleaguering as to why Spencer has taken this action now. His decision is being attributed to being spurned by Nirvana with him talking about how the band had refused to appear at an art show of his.
